| （华南师范大学，广东 广州 510631） 摘 要：国际体育法正在形成和发展之中，国际体育的发展是国际体育法产生的基础，19世纪末国际体育组织的出现，尤其是国际奥委会的建立，极大地推动了国际体育法的发展。国际体育法的渊源是指国际体育法规范的存在及其表现形式，国际体育法的渊源与国际法的渊源相比，既有同一性，又有特殊性，国际条约、国际习惯和一般法律原则是国际法的传统渊源，但随着国际体育的发展，尤其是过去30年国际体育运动商业化和社会化的蓬勃发展，国际体育纠纷与诉讼不断涌现，司法判例和体育软法正在成为国际体育法的渊源之一，并比在国际法的其他领域发挥着更大的作用。 |
