摘 要：粤港澳体育湾区建设是粤港澳大湾区建设在体育领域的具体实践，是推动粤港澳大湾区高质量发展、提升整体竞争力和国际影响力的重要抓手。法治是其建设的制度支撑、基本保障和实现路径。粤港澳体育湾区法治建设致力于促进体育要素跨境高效流通、推动体育治理协同机制有效对接和激发粤港澳大湾区体育市场自主活力。当前该法治建设主要以国家法律和中央政策为指引，通过地方立法、政策及三地政府间体育合作协议推进规则衔接与实践落地，但仍面临体育要素流通受阻、体育跨境治理协同不足和跨境体育纠纷解决机制衔接不畅等问题。研究认为，应先行推动三地构建体育产业协同立法机制，充分利用政府间体育合作协议完善要素流通规则，打破粤港澳大湾区体育要素流通的制度壁垒；创新体育跨境执法协同机制，构建政府、企业、民间体育组织和公众共同参与的体育协同治理机制，以提升体育跨境治理协同效能；探索扩大跨境体育纠纷司法协助范围和体育仲裁受案范围，取消“商事保留”限制，充分利用粤港澳大湾区现有调解资源处理体育纠纷，为体育市场主体提供稳定和可预期的权利救济保障。

The legal approach on building sports bay area in the Guangdong–Hong Kong–Macao

Abstract: The construction of sports bay area in the Guangdong-Hong Kong-Macao is a targeted practice of the Guangdong-Hong Kong-Macao Greater Bay Area initiative within the sports area, serving as a key driver for advancing high-quality development, enhancing overall competitiveness, and elevating international influence, and the rule of law provides institutional support, fundamental guarantees, and practical pathways for its development. The rule of law construction in sports bay area in the Guangdong-Hong Kong-Macao aims to facilitate the efficient cross-border flow of sports-related factors, align collaborative governance mechanisms, and stimulate vitality within the sports market. At present, such rule of law construction is mainly guided by national laws and central policies, and advances the convergence of rules and practical implementation through local legislation, policies, and sports cooperation agreements among the three regional governments, yet it still faces problems including impeded flow of sports factors, insufficient collaboration in cross-border sports governance, and inadequate alignment of cross-border sports dispute resolution mechanisms. This study proposes that priority should be given to promoting the establishment of a coordinated legislative mechanism for sports industry among the three regions, making full use of intergovernmental sports cooperation agreements to improve rules for circulation of factors and breaking institutional barriers to the flow of sports factors in the Greater Bay Area; innovating the coordinated mechanism for cross-border law enforcement in sports, establishing a collaborative sports governance mechanism with the joint participation of governments, enterprises, non-governmental sports organizations and the public, and improving the efficiency of cross-border sports governance coordination; exploring expanding the scope of judicial assistance in cross-border sports disputes and the scope of cases accepted by sports arbitration, lifting the “commercial reservation” restriction, and also making full use of the existing mediation resources in the Greater Bay Area to resolve sports disputes, to provide stable and predictable guarantee of right of sports market entities.
