Discussion on perfecting the internal dispute resolution system of sports association under the background of establishing sports arbitration in China YU Shanxu

Abstract: With the continuous advancement of the comprehensive rule of law and the increased demand for legal disputes settlement as well as rights protection, it has become a general consensus to add legal basis for sports arbitration in the amendment of Sports Law. However, when comprehensively considering sports arbitration in the overall sports dispute resolution system that manifests the characteristics of sports autonomy, it is necessary to focus on the implementation of the dispute resolution system in sports industry association because it exhausts internal remedies as the prerequisite of sports arbitration. Based on explicating the internal and external settlement of sports disputes and the relationship between sports arbitration and sports industry associations, and from the perspectives of dispute resolution agency and its documents, relevant provisions in the articles and the relevant provisions in other normative documents, this paper selects the online available data and sorts out the sports dispute resolution system in national individual sports association through analytical method. In this way, it is summarized that an initial foundation has been laid but there are still some shortcomings to be improved. Moreover, In order to link up the internal dispute resolution and arbitration of sports associations in China, it is suggested to seize the opportunity of law amendment and promote the new development of the dispute resolution system of sports associations, to establish status for sports arbitration from national sports federation and the Chinese Olympic Committee, to strengthen the internal system construction of national individual sports association, and to exert the role of network information in promoting the use of sports dispute resolution and arbitration learning propaganda.
