我国体育赛事转播权垄断问题及应对策略

摘 要:通过文献资料、专家访谈、比较分析等研究方法,探讨我国体育赛事转播权垄断问题。研究发现我国体育赛事转播过程中主要存在使用行政权力排除、限制竞争,集中销售与联合购买,使用市场支配地位等垄断行为;主要原因为我国特殊国情、体育赛事转播的经济性、赛事媒体转播机制以及反垄断法律法规的缺失等;提出健全中国体育赛事转播权反垄断法律法规,重构中国体育赛事转播权收益分配制度,规范中国体育赛事转播相关市场行为等应对策略。

The monopoly of broadcasting right with sports events in China and its countermeasures

Abstract: By the methods of literature review, expert interview, comparative analysis, this paper analyzes the development process of China's broadcasting right with sports events, and finds that there are several kinds of monopolistic behaviors in the process of sports events broadcasting in China, such as using administrative power to eliminate and restrict competition, centralized sales and joint purchase, and using the market dominant position. The main reasons includes that the special national conditions, the economy of sports events broadcasting, the lack of media broadcast mechanism, and the lack of anti-monopoly laws and regulations. Given that the study proposes some corresponding countermeasures as follows: perfecting the anti-monopoly laws and regulations of the broadcasting rights of sports events, reconstructing the income distribution system of the broadcasting rights of sports events, and standardizing the relevant market behaviors for the broadcasting of sports events in China.
