（1.西北政法大学 行政法学院（纪检监察学院），陕西 西安 710063； 摘 要：马克思主义人权观认为，人权是随着社会发展不断变化发展的。体育权随着经济、社会、文化的不断进步，逐渐受到全球人民的高度重视。在中国社会主义新时代的当下，体育权俨然逐渐兴起，成为一项新兴人权，无论其内涵是基本人权说、宪法权说、受教育权说还是体育运动权说，都是以肯定体育运动是一项人权为基础的。体育权的外延也极其广泛，女性、儿童、残疾人、难民等弱势群体体育权尤其需要加以重视。体育权基于天赋人权、马克思主义人权观及人类命运共同体等理论形成并得到认可，势必推动人权事业的进步和人类命运共同体的实现。未来体育权的发展也不可限量，将逐渐融入新时代人权谱系结构之中，并成为中国人权发展的重要内容，基于其特殊性还有望引领世界人权潮流。

With the constant advancing of economy, society and culture, sports right is gradually valued highly by people all over the world. At present, in the new era of Chinese socialism, sports right has emerged in a solemn and gradual way, becoming an emerging human right; no matter its connotations are interpreted as “basic human rights, constitutional rights, the rights to education or the rights to sports, they are based on affirming that sport is a human right. The extension of sports right is also extremely extensive. The sports rights of vulnerable groups such as women, children, the disabled, and refugees need to be valued especially. Sports right is based on natural rights, Marxist view of human rights and the formation and recognition of theories such as the community of human destiny; it will boost the advancement of the human right undertaking and the realization of the community of human destiny. In the future, the development of sports rights will be unlimited, gradually blended into the spec-trum structure of human rights in the new era, and become an important content of Chinese human right develop-ment, also possibly lead the world's human rights trend based on its particularity.
