| （1.南京大学 法学院，江苏 南京 210093；2.淮北师范大学 政法学院，安徽 淮北 235000） 摘 要：在刑法学和犯罪学双重视域下研究体育职务犯罪，既可以在规范意义上解读其构成要件，也能够将其放在社会背景下，研究其成因、特征、属性，从而更为科学全面认识这一现象，进而制定相应的防控对策。体育职务犯罪因其主体、发生场域、属性和行为方式不同划分为不同类型。体育职务犯罪成因复杂、类型多样，需构建分级应对、逐层递进、多方参与的一体化防控体系。为此，至少要在体育职务犯罪防控主体界定和防控策略制定两个方面加以阐释。 |

| （1.Law School，Nanjing University，Nanjing 210093，China；2.Law School，Huaibei Normal University，Huaibei 235000，China) Abstract: Studying sports duty crimes from the double perspectives of criminal jurisprudence and criminology en-ables us not only to interpret their constitutive requirements in the sense of norms, but also to study their causes, characteristics and attributes by putting them under the social background, thus to understand such a phenomenon in a more scientific and comprehensive way, and then to establish corresponding prevention and control measures. Sports duty crimes are sorted into different types due to their differences in subjects, fields of occurrence, attributes and behaviors. Due to the complicated causes and diversified types of sports duty crimes, an integrated prevention and control system with leveled responding, layer by layer furthering and multi-party participating needs to be built. Therefore, sports duty crimes should be interpreted at least in terms of sports duty crime prevention and control subject definition as well as prevention and control strategy establishment. |
