(武汉大学 国际法研究所,湖北 武汉 430072) 摘 要:底价仲裁制度是美国职棒大联盟中一种独特的薪资纠纷的争议解决方式,它伴随自由球员制度的形成而形成。底价仲裁制度限制了仲裁人的自由裁决,在提起仲裁的条件及听证、仲裁的标准等方面存在特有的规则。这一制度经过30年的发展对大联盟运动员薪资和劳资关系产生了积极的影响,缓和了劳资矛盾,提高了球员的薪资水平,其本质在于“与其说是解决纠纷,不如说是推动谈判”。底价仲裁制度存在移植于我国的职业联赛的可能,有助于解决当前职业体育领域的薪资结构不合理的现象。 |

(Institute of International Law,Wuhan University,Wuhan 430072,China) Abstract: The final offer arbitration (FOA) system is a unique way to settle salary disputes in Major League Base-ball (MLB), formed with the formation of the free player system. The FOA system restricts the free arbitration of the arbitrator, having particular arbitration rules in terms of conditions for arbitration application, hearing and arbitration standards. This system has, after 30 years of development, produced positive effects on the relation between the la-bor and salary of MLB players, relieved the employee-employer relation, and increased the salary level of the play-ers. Essentially, it boosts negotiations rather than settles disputes. There is a possibility for FOA to be introduced into professional tournaments in China, since it is conducive to solving irrational salary structure related problems existing in the professional sports area today. |
