(武汉大学 法学院,湖北 武汉 430072) 摘 要:国际体育仲裁院2008年裁决了奥斯卡诉国际田径联合会案,认为在现有条件下,奥斯卡使用假肢没有违反国际田径联合会规则,支持奥斯卡作为一名残疾运动员可以使用假肢参加健全人的田径比赛。国际体育仲裁院对该案裁决体现了体育内在精神的要求,有利于体育的发展,是对运动员参赛资格的保护,特别是对残疾运动员利益的保护,维护了程序正义。这一裁决符合对疑义规则的解释不利于规则做出者的要求。 |

(School of Law,Wuhan University,Wuhan 430072,China) Abstract: The Court of Arbitration of Sport (CAS) arbitrated the Oscar against the International Amateur Athletics Federation (IAAF) case in 2008, concluded that under the existing conditions the artificial limbs used by Oscar did not violate the rules of the IAAF, and supported that Oscar as a handicapped athlete can participate in track and field competitions for physically sound athletes by using artificial limbs. The arbitration of the CAS over this case em-bodies the intrinsic spiritual requirements of sport, being conducive to the development of sport, being the protec-tion of athlete’s qualification for competition participation, especially the protection of the interests of handicapped athletes, having maintained procedural justice. This arbitration meets the requirement of that the interpretation of ambiguous rules should be unfavorable to the rule maker. |
