| （1.天津体育学院 体育法学研究所，天津 300381；2.河北体育学院，河北 石家庄 050041） 摘 要：明晰体育权利的性质、内涵和属性是体育立法、执法和司法及体育法学研究与交流的前提与基础。研究认为国际体育文件是体育权利的渊源；体育权利本质上是人在接受体育教育和参加体育运动过程中所应享有的自由与利益；体育权利由体育运动权和体育教育权两项核心子权利构成；我国体育权利总体上属于社会文化权利且目前为推定性权利；体育权利具有基本权利的各项属性。我国体育立法及《体育法》的修改应按照权利立法的要求进行相应的制度设计，实践中应以全民健身事业作为根本目标和价值取向并进行相应的资源配置。 |

The authors drew the following conclusions：international sports documents are the source for sports rights; essen-tially sports rights are the freedom and interests that should be owned by people in the process of accepting physical education and participating in physical exercise; sports rights are composed of two core subsidiary rights, namely, physical exercise right and physical education right；In China sports rights belong to social cultural rights in general, and currently presumed rights；sports rights have all the attributes of a basic right.Corresponding system design should be carried out for the revision of sports legislation and the Sports Law in China, while in practice corre-sponding resource allocation should be made based on the undertaking of nationwide fitness as the fundamental goal and value orientation. |
