论学校在学生伤害事故中的法律责任

摘要：学校与学生之间的关系是一种教育、管理和保护的关系。在处理学生伤害事故时，学校承担责任的归责原则是过错责任原则，兼顾适用公平原则。为解决学生伤害事故问题，学校应采取多种预防措施，建立社会保险，转移风险责任，并成立专门机构处理学生伤害事故纠纷。

Abstract:This paper thinks that it is an educational and managing and protective relation between schools and students. When dealing with students' casualty accident, the liability principles that schools should bear are fault liability and equitable liability, not liability without fault. To resolve the problem of students' casualty accident, schools should take many preventing measures and construct social insurance systems. It is also necessary that found special organizations to deal with students' casualty accident.
