(1.集美大学 体育学院,福建 厦门 361021;2.湖北大学 体育学院,湖北 武汉 430062;3.集美大学 诚毅学院,福建 厦门 361021) 摘 要:大众健身场地不足是社会资源分配失衡的表现之一,客观上有悖于《宪法》精神并制约着公民体育权利的实现。研究依据《“健康中国2030”规划纲要》精神,并参照《全国国土规划纲要(2016—2030年)》规定,在宪法诠释、底线公平、公共服务法理论证的基础上,主张城市居住社区体育用地应该以“划拨”为主要方式实现有效供给;认为“建老百姓身边场地”实质是土地资源多方利益的博弈,不用专项立法不足以规制;并从法规的构成要素和践行路径提出初步设想。由此构成城市居住社区体育用地“划拨”正当性及法律规制阐释,力图为专项立法做必要的理论铺垫。 |

In accordance with Healthy China 2030 Planning Outline, and by referring to the stipulations of National Land Planning Outline (2016 - 2030), on the basis of constitution interpretation, bottom line fairness and public service legal principle demonstration, the authors advocated that sports land for urban residential communities should effective supplied mainly by the way of “allocation”, believed that “constructing venues around common people” is substantially the gaming of multiple in-terests of land resources, cannot be sufficiently regulated without the use of special legislation, and put forward a preliminary conception in terms of statutory constituent elements and practice path, thus formed explanation for the legitimacy and legal regulations of sports land “allocation” for urban residential communities, and strived to make necessary theoretical preparations for special legislation. |
