| （1.湖南师范大学 体育学院，湖南 长沙 410012； 2.长沙理工大学 体育教学部，湖南 长沙 410076） 摘 要：研究了体育权利的性质、特征、表现形式、实现途径。认为体育权利仍属于推断权利，它不指向具体的权利形式，而是体现于教育权、文化活动自由权、生存权、发展权、获得权利救济权等多种权利形式之中，是对多种权利形式的抽象与综合。体育权利法律化、公民具有强烈的体育权利意识、体育权利实现渠道畅通是体育权利得以实现的3个基本要素。在实现体育权利过程中，政府应积极发挥导向、规范、保障、干预、救助作用。 |

| (1.College of Physical Education，Hunan Normal University，Changsha 410012，China；2.Department of Physical Education，Changsha University of Science & Technology，Changsha 410076，China) Abstract: The authors studied the nature, characteristics, expression forms and realization channels of sports right, and considered that sports right belongs to an inferred right, which does not refer to specific forms of right, but em-bodies in various forms of right, such as the right of education, right of cultural activity freedom, right of existence, right of development, right of acquisition, and right of relief, being an abstract and comprehensive expression of various forms of right. Legalization of sports right, citizens having intense awareness of sports right, and unclogged channels for realizing sports right, are 3 basic elements for realizing sports right. During the realization of sports right, the government should actively exert its functions such as guiding, standardizing, assuring, interfering and re-lieving. |
